Article 1 – Purpose

These Terms and Conditions of Use (hereinafter referred to as the “Terms”) are intended to define the terms and conditions under which, on the one hand, the company SERMETA, hereinafter referred to as the “Publisher”, makes the website sermeta.com available to its users and, on the other hand, the manner in which users access the website.

Any natural person or legal entity wishing to access the website sermeta.com and its services is hereinafter referred to as the “User”.

The Terms must be accepted by any User, and access to the website sermeta.com implies acceptance of these Terms.

If the User does not accept the Terms set out in this agreement, they must refrain from accessing the services offered by the website sermeta.com.

Article 3 – Access to the Website

3.1

The website sermeta.com provides Users with free access to the following services:

  • Submission of job applications
  • Requests for product catalogs

 

3.2

Any User with internet access may access the website sermeta.com free of charge from anywhere. Any costs incurred by the User to access the website (internet connection, computer equipment, etc.) are not borne by the Publisher.

 

3.3

The Publisher endeavors to ensure access to the website 24 hours a day, 7 days a week, except in cases of force majeure or events beyond the Publisher’s control, and subject to possible breakdowns and maintenance operations necessary for the proper functioning of the website and services.

Consequently, the Publisher cannot guarantee website availability, transmission reliability, or performance in terms of response time or quality. No technical assistance is provided to Users, whether electronically or by telephone.

The Publisher shall not be held liable in the event of an inability to access the website sermeta.com.

 

3.4

The Publisher may interrupt access to the website sermeta.com or part of its services at any time, without prior notice and without entitlement to compensation. The User acknowledges and accepts that the Publisher shall not be held responsible for interruptions or any consequences resulting therefrom for the User or any third party.

Article 4 – User Responsibility

The User assumes full responsibility for the use of the information and content available on the website sermeta.com.

Any use of the services by the User that directly or indirectly results in damage shall give rise to compensation in favor of the Publisher.

The User undertakes to use respectful language and comply with applicable laws and accepts that their publications may be moderated or rejected by the Publisher without any obligation to provide justification.

By publishing content on the website sermeta.com, the User grants the publishing company a non-exclusive and free right to represent, reproduce, adapt, modify, distribute, and disseminate their publication, directly or through an authorized third party.

The Publisher nevertheless undertakes to credit the User in the event their publication is used.

The information and/or documents available on the website sermeta.com and/or accessible through it originate from sources considered reliable; however, the Publisher does not guarantee that they are free from defects, errors, or omissions.

Despite regular updates, the Publisher cannot be held responsible for changes to administrative or legal provisions occurring after publication. Likewise, the Publisher cannot be held responsible for the use or interpretation of information contained on the website.

 

5.2

Any malfunction of the server or network shall not engage the Publisher’s liability.

The Publisher cannot be held responsible for any viruses that may infect the User’s computer or IT equipment following use of, access to, or downloading from the website sermeta.com.

 

5.3

Similarly, the Publisher shall not be held liable in cases of force majeure or unforeseeable and unavoidable acts of a third party.

Article 6 – Intellectual Property

Trademarks, logos, signs, and all content on the website sermeta.com (texts, graphics, videos, etc.) are protected by copyright under the French Intellectual Property Code.

The User must obtain prior authorization from the Publisher before any reproduction, copying, or publication of such content.

 

Content may be used by the User for private purposes only; any commercial use is prohibited.

Any total or partial representation of the website sermeta.com, by any means whatsoever, without the express authorization of the Publisher, constitutes infringement under Articles L.335-2 et seq. of the French Intellectual Property Code.

Article 7 – Personal Data

The User must provide personal information in order to access certain services (catalog requests, online job applications).

The User’s email address may be used in particular for the communication of various information.

The website sermeta.com guarantees respect for the User’s privacy in accordance with French Law No. 78-17 of January 6, 1978 on data processing, data files, and individual liberties.

The Publisher reserves the right to modify these Terms at any time and without justification.

Article 10 – Applicable Law and Jurisdiction

The website and its terms of use are governed by French law, regardless of the place of use. In the event of any dispute, and after failure to reach an amicable solution, exclusive jurisdiction shall be granted to the Commercial Court of Brest, regardless of the place of use, order, delivery, or payment.
